The terms we make your book on.
Plain terms for a made-to-order product: how an order is formed, what happens at the proof, when you can cancel, and what we are responsible for if something goes wrong.

Who you are dealing with
Kito is a trade name of Stillbound Limited, a company registered in Kenya. Your contract is with Stillbound Limited. Where these terms say "we" or "us", that is who they mean.

These terms apply to every order placed through this website. Please read them before you pay — placing an order means you accept them.
What we make
We design, print and bind photo books from photographs you supply. Each book is made to your order: your pictures, your cover, your wording. Nothing we make is held in stock, and no two orders are the same.
The design work is done by people. Where we describe our process as assisted by software, that assistance supports human judgement rather than replacing it.
Printed colour varies slightly from what a screen shows, and paper stock and binding materials vary a little between production runs. We work to a consistent standard, but we cannot guarantee an exact match to your monitor.
Placing an order
Your order is an offer to buy. A contract is formed when we confirm your payment by email, and not before. If we cannot accept an order we will tell you and refund anything you have paid in full.
You may order up to 20 copies of the same book in one order. For more than that, write to us.
We may decline an order — for example where we cannot open the album, where the content falls outside what we will print, or where we cannot deliver to your location.
Prices and payment
Prices are shown in Kenya Shillings and include VAT. Delivery anywhere in Kenya is included in the price shown.
The full amount is payable when you order, by M-Pesa. Work begins once payment is confirmed. The amount is fixed by us at checkout and cannot be edited.
Payments are handled by Lipr on the Safaricom M-Pesa rail. You approve the payment on your own handset. We never see or hold your PIN.
If a price is obviously wrong — a mistake on our side rather than a bargain — we will contact you before starting work and you may confirm at the correct price or cancel for a full refund.
Your photographs and your rights in them
You keep every right you have in your photographs. We claim no ownership of them.
By sharing an album you grant us permission to open it, work from the photographs in it, and reproduce them in the book you have ordered. That permission covers making your book and nothing else. What we will not do with your pictures is set out in our privacy policy, and we hold ourselves to it.
By placing an order you confirm that you own the photographs or have permission to use them, and that printing them will not infringe anyone else's rights. Where a photograph was taken by a professional photographer, that photographer often holds the copyright — it is your responsibility to have their permission.
If a third party brings a claim against us because of something you asked us to print, you agree to cover our reasonable costs in dealing with it.
What we will not print
We will refuse an order, at any stage, where the content:
- is unlawful in Kenya, or depicts unlawful acts;
- sexualises a child in any way;
- infringes someone else's copyright, trademark or image rights;
- is intended to harass, defame or threaten a person;
- incites violence or hatred against a group.
If we refuse an order for one of these reasons before printing, we will refund you. If the content is unlawful we may be required to report it, and we will.
The proof, and your approval
We send a digital proof of your book by email, normally within two working days of payment. Two rounds of changes are included in the price.
Please check the proof carefully — spelling, names, dates, the order of the pictures, and which photographs made it in. Approving the proof is your confirmation that the book is right.
Once you approve the proof we print it as approved. We cannot reprint free of charge for a mistake that was visible on the proof, including a misspelled name or a wrong date.
If you need more than two rounds of changes we will quote for the extra work before doing it. If you go quiet after a proof, we will chase you twice and then hold the order; we will not print an unapproved book.
Making it and getting it to you
Production begins when you approve the proof. We will tell you the expected delivery date at that point, because it depends on the length of the book and the current queue at the bindery.
Any date we give is an estimate made in good faith. Where a delay is significant and caused by us, you may cancel and we will refund you in full unless the book has already been printed.
We deliver anywhere in Kenya, to the town or city on your order. Someone needs to be reachable on the phone number you gave us. If delivery fails repeatedly because we cannot reach you, we may charge the cost of a further attempt.
Risk in the book passes to you on delivery. Ownership passes when we have received payment in full.
Cancelling, and refunds
Because every Kito book is made to your personal specification, your right to change your mind is limited once work has begun. Specifically:
- Before we send your first proof — cancel for any reason and we refund you in full.
- After the proof but before printing — we refund you less a reasonable charge for the design work already done, which we will itemise.
- Once printing has begun — we cannot cancel or refund, because the book cannot be sold to anyone else.
None of this affects your rights where the book is faulty, damaged in transit, or not what you approved. Those are dealt with next, and nothing in these terms takes away rights you have under the Consumer Protection Act, 2012 or any other law that cannot be excluded.
Refunds are returned to the M-Pesa number that paid, normally within seven working days.
If something is wrong with your book
Tell us within fourteen days of delivery, at the address at the top of this page, with a photograph of the problem where you can.
If the book is faulty, damaged in transit, or differs from the proof you approved, we will reprint and redeliver it at our cost. Where a reprint is not possible we will refund you.
This does not cover ordinary wear, damage after delivery, or a change of mind about a choice you approved.
Keep your own copies
Kito is not a backup service. We delete our working copies thirty days after delivery, and we are not responsible for keeping or restoring your photographs. Keep your originals.
Your album stays on your own Google or Apple account throughout. We only ever hold a working copy, for as long as it takes to make your book.
Our responsibility to you
We are responsible for loss you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill.
Except where the law does not allow us to limit it, our total liability for any order is capped at the amount you paid for that order.
We are not liable for loss of, or damage to, photographs held on your own devices or accounts, nor for any loss of profit, business or opportunity.
We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
Things outside our control
If something beyond our reasonable control prevents or delays us — a failure of the power or telecommunications network, industrial action, civil unrest, a supplier's collapse, or a natural event — we will tell you as soon as we can and the delay will not be a breach of these terms. If it goes on for more than thirty days, either of us may cancel and we will refund what you have paid for work not yet done.
General
We may change these terms, but the terms that apply to your order are the ones published when you placed it.
If any part of these terms turns out to be unenforceable, the rest continues to apply.
We may transfer this contract to another business, but your rights under it will not be affected.
These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute. Please come to us first — most things are quicker to fix by email than by anything else.
